In addition, in the event of deprivation/suspension of an organization’s state accreditation, students cannot be guaranteed a deferment from conscription into military service.

In 2017, Rosobrnadzor deprived dozens of universities across the country of accreditation and licenses. In recent months, hundreds of students from MITRO, the First Moscow Law Institute, the Moscow Academy of Economics and Law and other universities have been left out of higher education, many before defending their diplomas. Students are worried about the future of their education, and for good reason. A university without accreditation does not have the right to issue state diplomas, because the presence of accreditation just means that the quality of education corresponds federal standards. Other privileges are also lost: students are no longer guaranteed a deferment from the army, the institution cannot use tax benefits or maternity capital when paying for tuition.

If accreditation is lost, the university must notify students within five working days and also post an announcement online. However, as a rule, management withholds information until the last minute, and for many students the news comes as a surprise.

Lack of accreditation does not deprive a university of the opportunity to educate students. In accordance with the Federal Law “On Licensing of Certain Types of Activities,” a university will close only if it loses its license. A university deprived of accreditation can issue its own diploma - a non-state standard, but such a “crust” has no value.

"This document is in modern conditions nobody needs. Both in professional organizations and firms, and in the civil service, a non-state diploma is not valued. With it, among other things, you cannot enroll in a master’s program or get a second higher education,” explains Grigory Shabanov, vice-rector for academic affairs at RosNOU.

How to transfer to another university

If a student does not want to remain a dropout, the only way out is to complete his studies elsewhere. The procedure for transferring from a university deprived of accreditation is regulated by the Federal Law “On Education in the Russian Federation.” It sets out a special procedure that guarantees that students' rights are respected. By law, the university is obliged to ensure the transfer of students to other universities while maintaining the conditions of study. State certification at another university

Sometimes universities that have been deprived of accreditation do not inform students about this and proceed with graduation as if nothing had happened. In this case, in order to receive a state diploma, students have the right to undergo state final certification as an external student at an accredited university.

“The Russian New University provides the opportunity for students of other universities to pass the GIA, but only if they studied in the areas of training that we have. Otherwise, we would have to separately develop a huge package of methodological and regulatory documents for each profile. In addition, not all universities conscientiously comply with the legislation in the field of education, and we cannot take their students either,” says the vice-rector of RosNOU.

According to Shabanov, the duration of the procedure depends on how prepared the student is. All disciplines studied after the university was deprived of accreditation are subject to re-certification. This also applies to practice, so the university must find time to conduct consultations, recertify the person, schedule a defense time, provide time to prepare for the exam, and at the same time comply with all deadlines set by the Ministry of Education. As a rule, this takes from three to six months. The student receives a diploma from the university in which he passed the state final certification.

In what cases can you receive compensation?

At the end of June, it became known that seven humanitarian specialties of the Altai State Technical University (AltSTU), which means that more than 100 graduates may be left without state diplomas.

Previously, the rector of the university was dismissed by the Minister of Education of the Russian Federation Dmitry Livanov, but the fear of not getting a decent diploma still hovers among senior students.

Despite the fact that the acting rector of the Altai university returned from Moscow, where a day earlier he had been summoned to the Ministry of Education and Science for proceedings, and students were informed (unofficially for now) that they would be transferred to Altai State University (AltSU) to undergo final certification and receive a state diploma , according to the student victims of what happened, today members of the university management are putting pressure on them and asking them to “quietly” still pass exams at their home university: supposedly otherwise there will be no chance at all for a decent diploma.

The first way is to ask

If the students were not state employees and paid money for education, then you can ask for a refund and compensation, including for moral damage. According to the order, the university must issue state-issued diplomas to students whose names were recorded upon admission to the university at a time when its accreditation had not yet been revoked. If there is a possibility that accreditation will be revoked, students should be warned about this in advance. And graduates are the last ones who should suffer from this, the lawyer added.

Choose a university by reputation, see ratings of successful universities, view documents judicial practice. For example, in bankruptcy cases: is this university bankrupt? All information about licenses of any educational institutions in Russia are contained in a single database of Rosobrnadzor.

Monitor educational sites. At least follow the news on the website of the Russian Ministry of Education, if we are not talking about top universities. It makes sense to apply for training at universities that have more or less proven themselves.

Remember: if you have a commercial university, it is more likely to be deprived of accreditation. If the university has established traditions and reputation, then there will be no prerequisites for deprivation of accreditation or license. With private universities, not everything is clear. For students, this is still a risk.

As of July 1, 2016, Rosobrnadzor completely suspended state accreditation of eight universities, 11 more educational institutions prohibited from accepting applicants. At the same time, for “failure to eliminate inconsistencies in the content and quality of training of students,” four of them were deprived of state accreditation for higher education programs.

Rosobrnadzor starts... and wins!

This department regularly conducts inspections of universities (state and commercial) and their branches. If a violation is discovered for the first time, the first method is a ban on admitting applicants. This is more of a preventive measure, so the university has the right to continue educational activities.

If violations are repeated during the re-inspection, then Rosobrnadzor applies more stringent methods - temporarily suspends the state accreditation of the university. Moreover, it may be suspended in certain areas of training.

At the same time, the university cannot conduct final state certification and issue diplomas, and cannot provide a deferment from military service. And finally, if even after this Rosobrnadzor reveals a repeated violation, then the university has to be completely deprived of accreditation.

Rosobrnadzor started 2016 with decisive measures. Thus, the accreditation of the Kabardino-Balkarian Institute of Business (KBIB) was canceled - this is a punishment for the fact that previously identified violations (the quality and content of the training programs did not meet the requirements) were not eliminated. Back in August 2014, right before the start of the next academic year, Rosobrnadzor banned the university from accepting applicants. Then, in October last year, his accreditation was suspended and, finally, he was deprived of it.

Meanwhile, in defense of this non-state university came public figures Kabardino-Balkaria. Thus, back in February 2015, a member of the Republican Public Chamber, Valery Khatazhukov, sent an “Open Letter” to the newly appointed head of Kabardino-Balkaria, Yuri Kokov. Khatazhukov writes that KBIB is one of the few successfully operating commercial universities in Russian province, and even more so in the North Caucasus.

He accuses Rosobrnadzor of bias during the inspection, which revealed, among other things, 66 violations. Khatazhukov invites Kokov to initiate an independent, public review of all the comments voiced. At the same time, the rector of the university, Felix Kharaev, went to court, demanding to resume the activities of the institution, and after “ Open letter“The decision was made in favor of the institute. But, as you can see, the victory was not celebrated for long... However, KBIB is now trying to challenge the deprivation of accreditation in arbitration.

The Rostov Institute is fighting in the courts

Rosobrnadzor has repeatedly identified violations in the work of two more southern Russian universities - the Volgograd branch of the International Institute of Economics and Law (MIEL) and the Stavropol branch of the South Russian Humanitarian Institute (URGI). Admission to the Mikhailovsky branch of the Volgograd State Social Pedagogical University (VGSPU) is also prohibited.

Let us recall that since the beginning of the current academic year, Rosobrnadzor has suspended the accreditation of 17 branches and 4 autonomous universities in the south (in whole or in certain areas). Here is their full list:

Rosobrnadzor had to apply even more stringent measures against several other universities. In particular, the Rostov Socio-Economic Institute (RSEI) was deprived of state accreditation, but not completely, but only in two areas - “ Humanitarian sciences" and "Economics and Management". Now only lawyers can be trained here... By the way, the institute is now challenging the conclusions of the audit immediately in the Arbitration Court Rostov region and the Moscow Arbitration Court. The Rostov branch of the Moscow Institute of Entrepreneurship and Law (MILP) has been deprived of accreditation completely, and not for individual areas.

"Sharashkin's offices" from Dagestan

Often, Rosobrnadzor, as we have already said, has to defend its positions in the courts, often as a plaintiff, but more often as a defendant. Let's say, in recent months, two high-profile court decisions have been made to revoke the licenses of universities in Dagestan, one religious (Institute named after Sayidmukhammad-Khaji Abubakarov), and the second - emphatically secular (this is the name of the Secular Institute of the Peoples of the Caucasus, SINK). Both were excluded from the state register of educational institutions.

For example, an inspection carried out in the Institute of Scientific and Technical Sciences in April 2014 revealed almost two dozen violations: the university did not have a library, a physical education facility, equipped laboratories, and in some specialties there were not even curricula. The website lacked information for applicants, and the contracts for paid training the cost of this training itself was not indicated. In short, it’s a typical sharashkin’s office. And for some reason it is not surprising that it is in Dagestan.

It’s the same story with the Institute named after Sayidmukhammad-Haji Abubakarov: there are no own premises, textbooks, training manuals, there are not even teachers... In general, it is not clear who and what can be taught here. It is clear that the court’s decision to close the university did not challenge it.

But this is already the third year litigation Rosobrnadzor and another Dagestan religious university - the Islamic University named after Sheikh Abdullah Efendi (located in Derbent). A license to carry out educational activities was issued to him in November and March of this year, and six years after the inspection, Rosobrnadzor tried to revoke it. At first, the arbitration court of Dagestan rejected the claims of the inspectors against the university, but then the case was returned for reconsideration, and this time - a year later - the license was still taken away. Now the Islamic University is trying to prove its case in the Supreme Court of Russia.

Rosobrnadzor had to cancel the license of the intractable Rostov Institute through the court foreign languages(RIIA). At the same time, they are trying to challenge in court the actions of Rosobrnadzor and several other universities, in particular, the Businesstrans Institute from Stavropol, whose accreditation was suspended in July last year.

But officials are not always right. Last Thursday in Volgograd, an arbitration panel recognized the Volgograd Humanitarian Institute (VHI) as right: Rosobrnadzor, which tried to take away the university’s accreditation last September, acted illegally.
